5. Regina v. E. F. [Calgary PC, August, 2007]

Client was apprehended by the police while smoking a “joint” in downtown Calgary. As a consequence of the police search of E. F. he was found to be in possession of multiple packages of cocaine and cash. Client was charged with possession of cocaine for the purpose of trafficking and proceeds of crime. The search of E. F. was successfully challenged on constitutional grounds and a deal was struck prior to commencement of trial for resolution by way simple possession and a fine.
