2. Regina v. R.V. [Court of Queen’s Bench of Alberta, Calgary – February 2010]

Client charged with possession of cocaine for the purpose of trafficking and proceeds as a consequence of a police stop of a motor vehicle driven by client. Police seized approximately half an ounce of cocaine from client’s person and another half ounce (and cash) from the motor vehicle. The case was challenged on constitutional grounds resulting in the entry of a stay of proceedings after preliminary inquiry and before commencement of trial proceedings.
